Are WhatsApp AI chatbots banned in 2026? What businesses can still automate

By Prilient ·

No. Meta has not banned AI chatbots that businesses use with their own customers. Since 15 January 2026, WhatsApp's Business Solution Terms bar companies whose main product is a general-purpose AI assistant, such as ChatGPT or Perplexity, from the WhatsApp Business Platform. If your bot answers your customers, qualifies leads, books appointments or sends order updates, it is still allowed.

Headlines in late 2025 read "WhatsApp bans AI chatbots", and the question still comes up in 2026. Below: what changed, where the rule differs by country, the rules every business bot already had to follow, and a checklist to keep your bot on the right side of all of them. If you are planning a bot, see our WhatsApp AI chatbot development service.

What Meta changed, and when

On 15 October 2025 Meta added an "AI providers" section to the WhatsApp Business Solution Terms. It stops providers of AI technology, such as large language models and general-purpose assistants, from using the platform when that AI is the primary functionality, "rather than incidental or ancillary". It applied to new providers at once and to existing ones from 15 January 2026, and Meta decides what counts as primary. Meta's stated reason: these assistants put a strain on systems that were not designed for them.

Regulators in Europe and Brazil pushed back, so the rule now depends on where your customers are:

DateWhat happened
15 Oct 2025Meta publishes the AI-providers rule; it applies to new AI providers straight away
4 Dec 2025The European Commission opens an antitrust investigation
24 Dec 2025Italy's competition authority (AGCM) orders Meta to suspend the rule; Meta exempts Italian (+39) numbers
12–15 Jan 2026Brazil's competition authority (CADE) orders a suspension; Meta exempts Brazilian (+55) numbers
15 Jan 2026The rule applies to all other existing AI providers; general-purpose assistants such as ChatGPT stop working on WhatsApp outside the exempt countries
Feb–Mar 2026Meta replaces free access in Italy and Brazil with a per-message fee for AI providers
9 Jun 2026The European Commission imposes interim measures: Meta must restore free access for rival AI assistants within five working days
Jul 2026General-purpose assistants are reported back on WhatsApp across the EEA

None of these steps limits a business's own customer-service bot. The fight is between Meta and AI companies that want WhatsApp as a distribution channel.

What businesses can still automate on WhatsApp

The test is simple: is the AI chat the product you sell, or a tool that serves your own customers? Meta said the policy "does not stop businesses from providing customer service via bots within WhatsApp to their customers". These flows stay allowed:

  • Customer support: FAQs, order status, returns and delivery questions.
  • Lead qualification: asking about budget, location, timeline or need, scoring the lead and booking a call.
  • Appointments: booking, rescheduling, cancelling and reminders, for clinics, salons, property visits and service calls (see AI receptionists for clinics).
  • Order and payment updates: confirmations, invoices, renewal and payment reminders, sent as approved utility templates.
  • Collections: polite reminders and payment links, within your local consumer-credit and debt-collection rules.

Using a large language model inside these flows is fine. The rule is about what the bot is, not which model runs it. What is not allowed: a WhatsApp number that offers the public an open-ended assistant ("ask me anything"), or a service whose main value is the AI conversation itself. If you are building agents that act inside your own systems, see AI agent development.

The rules every WhatsApp bot already had to follow

These did not change in 2026, and they are where most bots get numbers restricted:

  • Opt-in first. You may only message people who gave you their number and agreed to hear from you on WhatsApp.
  • The 24-hour window. Free-form replies, including bot replies, are allowed for 24 hours after the customer's last message. Outside it, you can only send a pre-approved template.
  • A way out of the bot. WhatsApp's Business Messaging Policy allows automation inside the 24-hour window but requires "prompt, clear, and direct escalation paths": a hand-off to a person, a phone number, email or a web form.
  • Per-message pricing. Since 1 July 2025 Meta charges per delivered template message (marketing, utility and authentication), with rates set by the recipient's country. Replies inside the 24-hour window are free, utility templates sent inside it are free, and chats that start from a Click-to-WhatsApp ad open a 72-hour free window.
  • The official platform only. Bots must run on the WhatsApp Business Platform (Cloud API) through Meta or a provider; tools that automate the ordinary WhatsApp app break WhatsApp's terms.

Serving customers in the EU? Add the AI Act

Article 50 of the EU AI Act requires that people are told they are talking to an AI system unless it is obvious, and it applies from 2 August 2026. The Digital Omnibus, in force since 27 July 2026, moved the high-risk duties for uses such as hiring and credit scoring to 2 December 2027, but it did not move chatbot disclosure. One line in the bot's first message ("Hi, I'm the AI assistant for your business; type 'agent' to reach a person") meets it, and is good practice in every market.

Checklist: a WhatsApp AI chatbot that stays within the 2026 rules

  1. Runs on the official WhatsApp Business Platform with a verified business number.
  2. Stays on your business: its knowledge and instructions cover your products, services and policies, and it declines unrelated requests.
  3. Says it is an AI assistant in its first message.
  4. Records each customer's opt-in, with the date and where it was given.
  5. Hands over to a person on request, when the customer is frustrated, or when a question is outside its rules, and shows a phone number or email.
  6. Uses approved templates for anything sent outside the 24-hour window, in the right category (marketing or utility).
  7. Keeps only the data it needs and deletes it on request, in line with India's DPDP Act, UK GDPR or the EU GDPR as they apply to you.
  8. Gets a weekly review of its answers, hand-offs and opt-outs.

What this looks like in practice

Our own WhatsApp Lead Generation Agent follows this pattern. It asks about budget, location, timeline or need, scores the lead and books a call for hot prospects. Each chat creates or updates a contact in your CRM with the answers, the lead score and the outcome. When a customer asks for a person, gets frustrated or needs something outside its rules, it hands the chat to your team with the full context.

Questions about WhatsApp AI chatbots in 2026

Are AI chatbots banned on WhatsApp in 2026?

Not for businesses using AI with their own customers. Since 15 January 2026, Meta's WhatsApp Business Solution Terms bar companies whose main product is a general-purpose AI assistant, such as ChatGPT or Perplexity, from the WhatsApp Business Platform. A business that uses AI to answer its customers, qualify leads, book appointments or send order updates is still allowed.

Can my WhatsApp bot still use ChatGPT or another large language model?

Yes. The rule is about what the bot is, not which model runs it. A bot powered by a large language model that answers questions about your business, products and bookings uses AI as a supporting feature. Keep it scoped to your business and do not offer an open-ended assistant that answers anything.

Is ChatGPT available on WhatsApp in Europe and Brazil?

The rule does not apply the same way everywhere. Meta exempted Italian and then Brazilian (+55) numbers in December 2025 and January 2026 after competition regulators stepped in, and on 9 June 2026 the European Commission ordered Meta to restore free access for rival AI assistants. Elsewhere, general-purpose assistants remain barred from the WhatsApp Business Platform.

Does a WhatsApp chatbot need a human handoff?

Yes. WhatsApp's Business Messaging Policy allows automation inside the 24-hour customer service window but requires prompt, clear and direct escalation paths, such as a transfer to a human agent, a phone number, email or a web form.

What does it cost to run a WhatsApp AI chatbot in 2026?

Since 1 July 2025, Meta charges per delivered template message (marketing, utility and authentication), with rates set by the recipient's country. Replies inside the 24-hour customer service window are free, utility templates sent inside that window are free, and chats started from Click-to-WhatsApp ads open a 72-hour free window. AI model and build costs come on top.

Does the EU AI Act affect WhatsApp chatbots?

Yes, if you serve people in the EU. Article 50 of the EU AI Act requires that people are told they are interacting with an AI system unless it is obvious, and it applies from 2 August 2026. Saying so in the bot's first message meets that requirement and is good practice everywhere.
